Criminal Record Check

Under West Virginia Code 15-2-24(d)

The Criminal Identification Bureau may furnish, with approval of the Superintendent, fingerprints, photographs, records or other information to any private or public agency, person, firm association, corporation or other organization, other than a law enforcement or governmental agency as to which provisions of subsection (c) of this section shall govern and control, but all requests under the provisions of this subsection (d) for such fingerprints, photographs, records or other information must be accompanied by a written authorization signed and acknowledged by the person whose fingerprints, photographs, records or other information.

Expungements

What is an expungement?
An expungement is the removal of criminal charges from a persons criminal record.

What is the proper procedure when requesting to have a record expunged?
The individual requesting expungement should submitto a background check as outlined above, to determine whether said charges are filed with this agency.
Once information is received from requested background check, contact the Circuit Clerk of the County of jurisdiction from which the arrest originated.
Finally, petition the Circuit Court for an expungement. All relevant papers and forms are available through the court system. Papers are to be filed with the Circuit Court.

How will an individual be notified once the expungement is complete?
The West Virginia State Police Criminal Records Section will send a certified letter back to the Circuit Court Clerks office notifying the clerk that the record has been expunged.

Are calls received at the Criminal Records Section to obtain the status of an expungement?
No. All communications are made with the Circuit Clerks office.
